OFFICIAL CONTEST RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The Fire-Dex Contest is governed by the following Official Contest Rules (“Official Rules”). By participating in the Contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results, as determined by Fire-Dex, LLC (“Fire-Dex”), are final in all respects. Contests are subject to all federal, state, and local laws and regulations and is void where prohibited by law.
ELIGIBILITY
Contests are open to legal residents of the 50 United States and the District of Columbia, where not prohibited by law, who are eighteen (18) years of age or older at the time of entry. Fire-Dex has the right to verify the eligibility of each entrant. Void where prohibited.
CONTEST PERIOD
Fire-Dex will hold the Contest for one week out of each month (each, a “Contest Period”). Fire-Dex reserves the right to extend or shorten the Contest Period at their sole discretion.
HOW TO ENTER
Entrants can enter the Contest through the official entry form on our website. Entrants must fill out all required fields on the entry form and agree to all terms outlined within our privacy policy.One (1) entry per person per Contest Period. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices to circumvent the Official Rules.
WINNER SELECTION
All eligible entries received during the Contest Period will be gathered into a database at the end of the Contest Period. Fire-Dex will select a winner at random from the database of eligible entries. Odds of winning depend on the number of entries received.
The winner will be announced via Fire-Dex’s website and/or social media accounts. Fire-Dex will contact the winner and provide instructions for claiming the award via the email address or phone number supplied on the potential award winner’s entry. Upon the request of Fire-Dex, the potential award winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form. Non-recipients will not be notified. If a potential winner is disqualified for any reason, Fire-Dex retains discretion to select and award the applicable prize to an alternate winner by random drawing from the remaining eligible entries. A winner’s list may be obtained by sending a self-addressed, stamped envelope to: Fire-Dex, LLC, Attn: Marketing, 780 South Progress Drive, Medina, Ohio 44256.
PRIZES:
Prizes consist of various Fire-Dex gear, swag/merchandise, or gift cards, as determined solely by Fire-Dex.
Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS THE SOLE RESPONSIBILITY OF THE WINNER. By entering in this giveaway, the individual confirms that participation does not violate policies of their employer.
ADDITIONAL LIMITATIONS
Prize is non-transferable. No substitution or cash equivalent of prizes are permitted. Fire-Dex is not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Fire-Dex. Fire-Dex reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Fire-Dex determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Fire-Dex control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, Fire-Dex reserves the right to void suspect entries at issue. Fire-Dex is not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, the inability to access any website or online service or any other error, human or otherwise.
INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS FIRE-DEX, THE FACEBOOK PLATFORM, ADMINISTRATORS AND ALL THEIR RESPECTIVE, EMPLOYEES AND REPRESENTATIVES FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. FIRE-DEX DOES NOT MAKE AND EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, AS TO THE QUALITY, CONDITION, FITNESS FOR A PARTICULAR PURPOSE, OR MERCHANTABILITY OF THE PRIZES AWARDED IN THIS CONTEST. ALL PRIZES ARE FURNISHED “AS-IS.”
GOVERNING LAW AND FORUM
Entrant agrees that all matters arising out of or relating to this Contest and these Official Rules are governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any of its conflict of law’s provisions or provisions which would cause the application of the laws of any jurisdiction other than the State of Ohio. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Contest and the Official Rules will be brought exclusively in the applicable federal or state courts located in Medina County, Ohio.
By participating, each entrant grants Fire-Dex permission to use his/her name, likeness, picture, or comments for publicity purposes without payment of additional consideration.
